Having sub-let the 320,000 sq ft distribution centre in Peterborough to Tesam Distribution for some time, the Co-operative called for our strategic advice and expertise when their landlord, The Prudential, served a terminal schedule of dilapidations shortly before the end of the lease in 2010. With a total claim of £1.2m, our principle aim was to find ways to limit the cost to The Co-operative.

We were appointed early on in the project by the Co-operative which enabled us to determine the best strategy for our client and to advise them accordingly. Innes England kept the lines of communication flowing between all parties – particularly Tesam and the surveyors acting for both tenant and landlord. To unburden The Co-operative of the additional cost of preparing a Schedule, we agreed with Tesam that they would respond to the Schedule served by the landlord. Through negotiating with the relevant surveyors, Innes England helped transfer the majority of the claim to Tesam. We also saw that The Co-operative was absolved of the responsibility for several of the remaining items of the claim. As part of these negotiations, we also helped to facilitate works required by Tesam, which proved more beneficial than agreeing a monetary settlement.
Innes England successfully reduced the initial claim from £1.2million to £29,000.
